These Terms of Use ("Terms") govern your use of bafastfreight.com (the "Site"), operated by BA Fast Freight Group Inc. ("BA Fast Freight," "we," "us" or "our"), a California corporation operating under USDOT 2895439 and MC-972948. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use the Site for lawful business purposes, including learning about our services, requesting quotes, booking meetings, requesting tracking information and applying to drive. You agree not to:
- Submit false, misleading or fraudulent information;
- Interfere with or disrupt the Site, or attempt to gain unauthorized access to any system;
- Use automated tools to scrape or collect data from the Site;
- Use the Site in violation of any law or regulation.
2. Quotes and transportation services
Information on the Site is for general purposes and does not create a contract for transportation. Quotes provided through the Site are estimates based on the information you supply and are subject to change, equipment and capacity availability, and final confirmation. All transportation services are governed by a separate written agreement, rate confirmation, bill of lading and/or our applicable rules and terms of service, which control over these Terms. Carrier liability for loss or damage to cargo is governed by those documents and applicable law, including 49 U.S.C. § 14706 where it applies.
3. Tracking and portal information
Tracking links, shipment status and other information we provide are offered for convenience. While we work to keep them accurate and timely, they may be delayed or incomplete and should not be relied on as the sole source for time-critical decisions.
4. Driver and carrier applications
Submitting an application does not guarantee an offer, contract or load. Any engagement of drivers or owner-operators is subject to our qualification process, applicable law and a separate written agreement.
5. Intellectual property
The Site and its content — including text, graphics, logos, page designs and software — are owned by or licensed to BA Fast Freight Group Inc. and are protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from the Site without our written permission. Third-party photographs are used under their respective licenses.
6. Third-party links
The Site may link to third-party websites and services. We do not control and are not responsible for their content, policies or practices.
7. Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BA FAST FREIGHT GROUP INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. This section does not limit liability for transportation services, which is governed by the agreements described in Section 2.
9. Indemnification
You agree to indemnify and hold harmless BA Fast Freight Group Inc. and its officers, employees and agents from claims arising out of your misuse of the Site or violation of these Terms.
10. Privacy
Your use of the Site is also governed by our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Los Angeles County, California, unless otherwise required by law or by a separate written agreement.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the updated Terms.
